From a legal point of view, I would like to make a reflection on three aspects that I consider fundamental to deal with the dimension of the problem today, providing it with a historical vision that conveniently contextualizes it.

In terms of their importance, we distinguish the Assets of Cultural Interest (BIC) that are duly registered by the Ministry of Culture and Sports and are considered the most relevant of our PHE according to their author, period, state of conservation, etc.    Those assets that do not have the uniqueness and specification of the BIC are recognized within the General Inventory of the PHE but that enjoy a special relevance for its remarkable historical, archaeological, scientific, technical or cultural value.

The cases of the forced transfer of the Parthenon friezes to the British Museum in London or the Pergamon Altar to the Pergamon Museum in Berlin are famous and well known. In these cases, they were acts of dispossession of an artistic heritage that belonged to an entire people, the transfer being decided as spoils of war. However, it is undeniable that the current location and technical means used in their maintenance have achieved their conservation and, undoubtedly, have been decisive in saving them from destruction or deterioration.

With this initiative we want to give a voice to the Saharawi people, who oppose the exploitation of their natural resources, and to make visible their suffering in the occupied areas, due to the systematic repression, and in the refugee camps, due to the conditions of exile and refuge.

Western Sahara is a non-self-governing territory pending decolonization, rich in natural resources that generates numerous economic benefits for Morocco and dozens of transnational corporations. Meanwhile, the Saharawi people are not guaranteed the right to self-determination or to the management and use of their own land and resources.

Meanwhile, the Saharawi women are forced to live in refugee camps in the Algerian desert or suffer repression by the occupying forces and discrimination in finding work in the occupied territories.

The occupied territories of Western Sahara possess some of the world’s largest phosphate reserves, its waters are rich in fish stocks, and its location offers access to large quantities of sand.    It also has great potential for the development of tourism and renewable energy.

Although at first sight, the subject of human rights seems very distant from the conservation of cultural heritage, the objective of this work is precisely to develop this linkage as well as to analyze the most frequent forms of violation of these rights, examining the different solutions and protective measures provided by the different branches of the legal system, both national and international, and with the aim of making its exposition more Cartesian, it has been divided into five chapters.

In the first, entitled “Approach to fundamental rights”, we seek to approach the concept of human rights through their historical evolution and, starting from their consideration as a dynamic phenomenon in constant expansion, to refer to the progressive recognition of new human rights, both domestically and internationally.

In the second chapter, “Culture as a right: cultural rights, identity and cultural diversity. Globalization and its impact on human rights”, emphasizes its relevance in maintaining human dignity and the positive social interaction of individuals and communities in a world characterized by cultural diversity and plurality, without forgetting the phenomenon of migration.
